From there, they’re distributed according to the will or the laws of intestacy if there’s no will. For me, it’s always about working closely with the executor and their legal team to ensure everything is accounted for properly and the funds are disbursed fairly and legally.
Who pays for repairs or staging?
In my experience, the estate typically covers the cost of repairs, cleaning, or staging, assuming there are funds available. Sometimes, if cash flow is tight but the improvements would significantly boost the sale price, I’ll personally guide the executor through low-cost, high-impact upgrades. In some cases, we’ve even deferred staging costs until after closing. Every situation is different, so it’s about being creative and strategic while respecting the estate’s financial position.
Do I need a lawyer to sell?
Technically, no—but in my opinion, yes. Probate sales involve legal timelines, filings, and responsibilities that go well beyond a typical sale. Having a probate lawyer or notary ensures the sale is legally sound and that the executor is protected. We’ve worked alongside dozens of legal professionals and can recommend trusted experts if needed. It gives everyone peace of mind.
What are the taxes involved?
Taxes can vary depending on the estate and how the property is held. In most cases, there’s no inheritance tax in British Columbia.
